Well if their pretty much the exact same thing, then yeah that would be copying.

I do have the sheet music in front of me. I take samples of other cadences all the time, but I never really copy all the parts together like that.

Oh well. He said it's a rough draft.

Ok, lets examine that no one would care comment....

Would your english teacher care if you wrote in a paper "ask not what your country can do for you, but what you can do for your country" in a term paper and tried to pass it off as your own? In reality, you are taking a drum cadence that famous in the marching percussion world and trying to pass a lick from it off as your own.

Just because in the marching percussion world, you don't have a teacher grading your work and calling you out, doesn't make it right to copy someone else's work

I'm not trying to pass that offf as my own. It's common knowledge and, it would have on the finale version, "partially taken from Electric Wheelchair."

In english, I would cite that quote. I take Pre Advanced Placement Honors English this year and next year, so my teacher encourages us to use a quote. In a rough draft that has not been published or turned in, I don't expect ANYONE to use my arrangments or composotions.

Also, like I said, that part has been edited.

Actually, you did publish or turn in your work. You posted it on a public website for everyone to see. Like it or not, agree with it or not, that is the reality of the situation. Someone downloading that score on mediafire would not know about this thread and would think that you are saying you wrote that whole piece. If the wrong person found it, they could pass it along to Gusseck and you could potentially get in trouble. Is that a very very unlikely scenario..of course..but individuals have been busted for music piracy, so it is feasible.

When you posted it, you mentioned nothing about it being "partially taken from electric wheelchair." You also mentioned nothing about it being a rough draft, and did not do so until the part about EW mentioned. So essentially, albeit unintentional, you tried to pass that off as your own.

Finally, what level english you take in high school has absolutely nothing to do with this conversation. I was using an illustration to make a point. How smart or dumb you are in English is irrelevant.

now, the question that will mess with you is....would you have changed the part if you weren't called on it?

personally I think that using a little two bar snippet is more of an "homage" than "stealing," kind of like "quoting" during a jazz solo, but I think I would have changed it at least a little bit. From a copyright law standpoint drumholio's right on, a great example is that song Bittersweet Symphony by The Verve. That song is based around a loop taken from a symphonic rendition of a Rolling Stones song. It's really only two bars over and over. And yet when the Rolling Stones found out they sued and ruined any musical success The Verve could ever hope to acheive.

Anyways, no one is telling you you're a bad person jacketsnare. Just be sure to give credit (on the sheet music) if you choose to copy someone's work in the future.

hehehe... during our black history moth program in febuary, our band director did a speech thing on music, and talked about Dvorak's New World Symphony, and how it resembled old... African American songs. It is sopposedly an exact copy, but it was never proven.

I have a quetion.


What if you were writing some music and wrote something from an already existant cadence (Like EW for example) but you had truthfully never heard or seen that cadence before. So you really did make the lick up by yourself for yourself.

So your claming that something is yours beacuse you wrote it, but someone else wrote the same thing before and you had no idea it even existed.


What then?

Well anything you write will probably look a lot like SOMETHING that's been written before. There's only so many combinations of rhythms out there. But if you're writing for drumline battery, the odds of you writing the exact same snare, tenor, and bass parts that someone else came up with are extraordinarily small.

Legally speaking, whether or not you've seen/heard it before is irrelevant, whoever came up with it first (and has proof) is entitled to the copyright, and anyone else using that copyrighted material without permission is doing so illegally.
