and now for my rant
-note...please realize that I am not speaking about any one group in particular in this rant, just the atmosphere of fear and control in general...

Although I will always respect the wishes of anyone who requests a take down, I will always be baffled at the thought of wanting to eliminate free publicity for your group. I could definitely be wrong as I don't pretend to be an expert on this, but I believe that these videos generate massive amounts of interest in the marching percussion sport. How many thousands of kids are downloading these videos, transcribing them and learning these things (judging from my server logs-SEVERAL THOUSAND DOWNLOADS A MONTH). How many people, after watching a video, are inspired to 1-go see a show, 2-transcribe the part, 3-learn the technique from several watchings, 4-write some music just as cool, 5-go buy a dvd from said group, 6-audition for said group, etc...I ask - how is this hurting the activity?
I could sort of believe that the issue is not securing rights for broadcast (aka publishing on the internet-a broadcast medium) but certain groups publish this media on the internet themselves so it's not as if they don't have the broadcast rights. It's all a matter of controlling the information out there.
Of course, I am willing to admit that releasing videos this early is a tad irresponsible as it does not represent the "best foot forward" that these groups are capable of, however, how many more kids are showing up to these lot performances to see these groups improve and "throw-down" as a result? Standing there taping on Saturday I could of sworn I was at a Jr. corps lot at a large regional. The venue in question that the aforementioned video(s) were from actually completely sold out and just a short time ago it was the site of the local championships. Growth indeed...
At any rate, continue to show your support for the groups. Continue watching these videos (whether on my website or youtube or myspace, etc..), continue transcribing, continue auditioning, continue attending shows, continue purchasing DVD's, continue to elevate the art form and let these groups know that you want to see them, in the lot, on the internet, on your dvd player, on your ipod/zune/psp, everywhere!

I don't believe they have a right to tell you that. If they didn't want any film of them, they wouldn't have allowed you to record in the first place. Or they would have had their show be private where nobody can observe them. I believe you should post it up again. No reason the people who couldn't travel to Chino Hills that Saturday should be denied viewing of this group. Its highly unfair.

I wonder if it might have anything to do with worrying about music publishers, rights, & royalties.

IIRC, when a synchronization license (the right to perform music combined with a visual medium) is granted, it's often done for specific performance venues. It's possible that the person or group holding the rights to a piece of music could consider videos posted online to be a violation of their synch license. Whether or not it actually is a violation of the license may be up for debate, but if it was my ensemble, I'd rather not be sued to find out.

Just try to get your website hosted on foreign soil like Canada, Sweden or something. Latency may suffer, but broadband connections generally don't care about that .


The percussive arts don't have enough money to legitimately bring lawsuits and legal action to court. We're not talking about making Metallica's album for freeleech or a site comparable to OiNK. I know some corps have alumni and members' parents who probably are good lawyers, but you know what, if the RIAA can't dictate law on foreign soil, I say you follow that line of thinking.

This isn't pirating DCI DVDs. This is NOT pirating of corps CDs or videos available at their merch trailers you find at summer shows. This is simply admiration of the groups talent and rehearsal performances that people have recorded. People need to stop being uptight with the legal crap and just let it go.

The internet is huge and they can keep on trying... but it won't be contained.


Seriously though, move your server offshore and ignore any email. Also, protect your WHOIS information.
